GENERAL TERMS & CONDITIONS
The following terms and conditions have been created based on the specific needs and nature of Avardumise Ruum (Avarduja OÜ, reg. no. 17045395, not subject to VAT), hereinafter also referred to as the website or e-shop, and govern the use of the services offered on this website.
These terms form a binding agreement between the website owner and the users, outlining in detail our policies and activities. By accessing or using the website, making a booking via email, or placing an order by phone, you confirm that you have read, understood, and agreed to these terms.
Users of the website must be at least 18 years old or of legal age in their jurisdiction and must have the legal authority, right, and freedom to enter into a binding agreement based on these terms. You may not use this website and/or receive services if doing so is prohibited under applicable laws or regulations in your country or jurisdiction.
By using this website, the user understands that the services offered do not replace any treatment prescribed by a medical doctor and will consult their healthcare provider if necessary.
By purchasing goods or services through this website, you agree that:
(i) You are responsible for reviewing the product or service description before committing to the purchase;
(ii) You enter into a legally binding contract to purchase the product/service when you proceed with payment (including payment in cash);
(iii) You acknowledge and accept personal responsibility when using the services.
SALES TERMS
The website Avardumise Ruum (hereinafter referred to as the Website and/or Web Store and/or e-store) is owned by Avarduja OÜ (registry code 17045395, not subject to VAT), with registered address at Tempera 3, Tartu, Estonia, 51011.
VALIDITY OF SALES AGREEMENT, PRODUCT & PRICE INFORMATION
1. These sales terms apply to the purchase of services/products from the Website, including booking services.
2. Prices for products and services sold on the Website are listed next to the relevant product/service. If a delivery fee applies, it will also be stated. Prices are in euros and do not include VAT. The Seller reserves the right to change prices and offer discounts.
3. The delivery fee depends on the buyer's location and selected delivery method. The delivery cost is shown during order checkout. If additional customs or tax fees apply due to local laws, the Buyer is responsible for paying them directly to the respective authorities.
4. Product/service descriptions are displayed directly next to each product/service in the Web Store.
5. If a product cannot be delivered due to unavailability or other reasons, the Buyer will be informed promptly and refunded within 14 days, including the delivery cost.
6. If a booked service cannot be provided, the client will be offered an alternative time or a full refund within 14 days of booking.
ORDER PLACEMENT
1. To order a product, the Client selects the desired product from the Web Store and adds it to the cart. Multiple items (including courses) can be ordered together. The final price is shown in the cart under "Total". The cart contents can be edited before the order is submitted. Clients must pay the price shown at the time of checkout. Prices may change before an order is placed.
2. To book a service (private session, group session, course, event), the Client selects the desired service, chooses a suitable time, and clicks "Next".
To finalize the order, the Client fills out required fields and clicks “Pay” or “Book”. The Client must provide accurate and complete name, email, and phone number. The Client is responsible for the accuracy of the data provided. The Seller is not liable for order issues caused by incorrect data.
After payment, the Web Store sends an order confirmation to the Client via email.
PAYMENT METHODS
E-gift card: Use the unique gift card code at checkout. The gift card is valid for 6 months from the delivery date.
Estonian bank payments via Make Commerce, card payments, Apple Pay & Google Pay: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Pocopay, Revolut, N26.
BUY NOW, PAY LATER: Inbank pay-in-3, pay-next-month, or installment plan.
Card payments: Enter card number, name on card, and security code.
Note: After bank payment, click "Return to Merchant". Payments are handled by Maksekeskus AS in a secure environment. The Seller does not access your bank/card data. Avarduja OÜ is the data controller and provides payment data to Maksekeskus AS for processing.
SERVICE CANCELLATION
Event and group session tickets are non-refundable and non-cancellable. Please find a replacement or reschedule. Sessions cannot be changed with less than 24h notice. Contact us to find the best solution.
You can reschedule by logging into your account and visiting “My Bookings”.
For private session changes, contact us at aliis@avardumiseruum.ee. If canceled or changed less than 24h before the service, the fee is not 100% refundable.
RIGHT OF WITHDRAWAL
1. You may exchange or return products within 14 days from the date of receipt.
2. To withdraw, send a withdrawal notice to aliis@avardumiseruum.ee.
3. Returns must be made the same way the product was delivered.
4. The Seller is not obligated to cover return shipping costs.
5. The Seller refunds the product and original shipping costs within 14 days of receiving the withdrawal notice, provided the product is returned within 14 days. Refunds may be withheld until the returned product is received or proof of return is provided.
Returned items must not be used, damaged, or incomplete. They must include packaging and all original content (manuals, certificates, etc.).
6. If used beyond its intended trial use, the refund may be reduced accordingly.
COMPLAINTS
1. Products are subject to a 2-year complaint period under VÕS § 218 (2). Disputes are resolved through negotiation.
2. Complaints must be submitted within two months of discovering an issue, to aliis@avardumiseruum.ee.
3. If a product is defective, the Seller will repair or replace it. If not possible, a full refund will be issued.
4. The Seller responds to complaints within 15 days.
5. Under § 222 (1), the Client may request repair or replacement. The Seller covers all related costs.
6. The Seller is not liable for damage caused by misuse or delivery delays due to force majeure.
LIABILITY
1. The Seller and Client are liable to each other for damages resulting from violations of these terms in accordance with Estonian law.
2. Seller liability is limited to the product price.
3. The Client agrees to use the Web Store for lawful purposes only.
TERMS AND MODIFICATIONS
1. By registering or purchasing, the Client agrees to these terms.
2. The sales agreement takes effect upon receipt of payment.
3. The Seller may change terms and prices without prior notice. Changes are published on the Web Store.
4. The Seller may cancel orders if the displayed price was incorrect due to a technical error.
DIRECT MARKETING & DATA PROCESSING
a. Personal data is used only for order fulfillment and delivery. Data may be shared with delivery providers.
b. Newsletters are sent only with the Client’s consent.
c. Users can manage notification preferences in their profile.
d. Clients can unsubscribe at any time by email or through the unsubscribe link in emails.
DISPUTE RESOLUTION
If you have complaints, email us at aliis@avardumiseruum.ee.
If unresolved, you may contact the Consumer Disputes Committee. Their services are free.
You may also use the EU Online Dispute Resolution platform.
PRIVACY TERMS
1. General Provisions
These privacy terms govern the principles of collecting, processing, and storing personal data. Personal data is collected, processed, and stored by the data controller Avarduja OÜ (hereinafter referred to as the "Data Controller").
a. A data subject, as defined by these privacy terms, is a customer or any other natural person whose personal data is processed by the Data Controller.
b. A customer, as defined by these privacy terms, is anyone who purchases goods or services from the Data Controller’s website.
c. The Data Controller follows the principles of data processing as set out in legal acts, including processing personal data lawfully, fairly, and securely. The Data Controller confirms that personal data has been processed in accordance with legal provisions.
These data protection terms have been drawn up in accordance with the European Parliament and Council Regulation (EU) No 2016/679 on the protection of natural persons concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Personal Data Protection Act of the Republic of Estonia, and other applicable Estonian and EU legislation.
2.What types of information do we collect?
Personal data collected, processed, and stored by the Data Controller is primarily gathered electronically through the website and email. We receive, collect, and store any information you enter on our website or provide to us in any other way.
a. By sharing personal data, the data subject grants the Data Controller the right to collect, organize, use, and manage personal data for the purposes defined in the privacy policy. This includes any data directly or indirectly provided when purchasing goods or services through the website.
b. The data subject is responsible for ensuring that the information provided is accurate, correct, and complete. Knowingly providing false information is considered a breach of the privacy policy. The data subject must promptly inform the Data Controller of any changes to the provided data.
c. The Data Controller is not liable for any damages caused to the data subject or third parties resulting from the provision of false information.
The Data Controller may process the following personal data of the data subject:
First and last name, phone number, email address, delivery address, account number, and the name of the payer (whether private or legal entity), as well as payment card details.
We also collect your IP address used to connect your computer to the Internet, login details, email address, password, computer and connection information, and purchase history.
We may use software tools to measure and collect session information, including page response times, visit durations for certain pages, page interaction information, and methods used to leave the page.
Additionally, we collect identifiable information (including name, email address, password, and communication), payment information (including credit card information), comments, feedback, product reviews, recommendations, and personal profiles.
Furthermore, the Data Controller has the right to collect data about the customer from public registers.
The legal basis for processing personal data is Article 6(1) (a), (b), (c), and (f) of the General Data Protection Regulation (GDPR):
a. The data subject has given consent to the processing of their personal data for one or more specific purposes;
b. The processing of personal data is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract;
c. The processing of personal data is necessary for compliance with a legal obligation to which the Data Controller is subject;
f. The processing of personal data is necessary for the purposes of the legitimate interests pursued by the Data Controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, particularly if the data subject is a child.
3. Why do we collect and store personal data for a long time?
a. To provide and manage orders, we store data for up to seven years after making a purchase.
b. To provide customer assistance, customer management and technical support, we store data for up to seven years after making a purchase.
c. To comply with applicable laws and regulations, including financial activities and accounting. we keep the data for 7 years after the last transaction.
d. In order to be able to contact our visitors and users with general or personalized service-related notices and advertising messages, we retain until the data subject expresses a wish to stop receiving the information.
Our company is hosted on the Wix.com platform. Wix.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com's data storage, databases, and general Wix.com applications. They store your data on secure servers behind a firewall.
All direct payment gateways offered by Wix.com and used by our company meet the standards established by PCI-DSS, which is administered by the PCI Security Standards Council, a collaborative effort of brands such as Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card data by our store and its service providers.
The data processor stores the data of the data subjects depending on the purpose of the processing, but not longer than 10 years.
4. Who do we share personal data with?
a. The data processor has the right to share customers' personal data with third parties, such as authorized data processors, accountants, transport and courier companies, companies providing transfer services. The data processor is the responsible processor of personal data.
The data processor transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS and the payment intermediary platform Stripe.com.
b. When processing and storing the personal data of the data subject, the data processor implements organizational and technical measures that ensure the protection of personal data against accidental or illegal destruction, modification, disclosure and any other illegal processing.
5. What are the rights of the data subject?
a. The data subject has the right to get access to his personal data and to consult them.
b. The data subject has the right to receive information about the processing of his personal data.
c. The data subject has the right to supplement or correct inaccurate data.
d. If the data processor processes the data subject's personal data on the basis of the data subject's consent, the data subject has the right to withdraw the consent at any time.
e. The data subject can contact our customer support at aliis@avardumiseruum.ee to exercise their rights.
f. The data subject can file a complaint with the Data Protection Inspectorate to protect his rights.
6. We do not collect information from minors and our website is not directed to minors.
7. Privacy policy updates.
We reserve the right to change this privacy policy at any time, so please review it often. Changes and clarifications take effect immediately after they are published on the website.
